    Presentation description:
In the introduction to the panel discussion, we will present an EU regulation that restricts naming of plant-based alternatives. Even though the regulation should be applied similarly across all member states, the State Agricultural and Food Inspection of Czechia has interpreted it in much narrower terms than we have seen elsewhere. It does not even allow for names such as "a plant-based alternative to XYZ". Therefore, we will take a look at a court case of Soyka vs.SAFI, in which the court confirmed the producers right to use the word "milk" as part of their product description.

    Více info

    Michal Jeřábek
    Presenting in Czech language
Mr. Tofu, whose real name is Michal Jeřábek, became a passionate vegetarian during his two-year stay in Indonesia. After returning to the Czech Republic, he confirmed that there is a lack of quality tofu here, and started producing it himself. He acquired a soy milk production machine and took over the Soyka brand. Soyka soon grew and began distributing products to Austria and Germany. Michal and his team were pioneers in the ecological packaging of tempeh and produced the first plant-based fermented yogurt in a glass. Soyka also uses returnable glass packaging. His wife Pavla also helps Michal with his business, and together with the children they participate in events and festivals. Soyka is known for the red star on the packaging, which symbolizes Michal's efforts for transparent labeling of plant products. It recently won a lawsuit over the use of the word "milk" on its product packaging and confirmation that it can label its products as a dairy alternative.

    David Zmrzlý
    Presenting in Czech language
David Zmrzlý is co-owner of the family business Puro shop, which has been running its own e-shop since 2016 and is a distributor of well-known plant-based brands such as Veganz, Oatly or Mondarella. Next year, the company plans to start producing milk alternatives from 2D printers. As a long-term importer and distributor, he has extensive experience with the complex topic of nomenclature. David has been eating plant-based for more than 10 years and is a supporter of the so-called clean diet - a diet that excludes the three A's - Alliums, Animals, Alcohol.

    Luboš Fojtík
    Presenting in Czech language
Ľuboš Fojtík is a partner of the law firm Konečná & Zacha, where he heads the litigation and arbitration department. Ľuboš has significant experience, especially in the field of complex construction disputes, representing developers, institutional investors and municipalities in court disputes. Other sectors in which he works include administrative justice, insolvency and a number of other sectors subject to public law regulation.

    Presentation description:
After a brief introduction to the issue of naming and marketing of plant-based alternatives, we will move onto a panel discussion with Michal Jeřábek and David Zmrzlý as representatives of small Czech plant-based producers. Lawyer Luboš Fojtík, who has represented Michal Jeřábek and his company Soyka in a court case against the State Agricultural and Food Inspection, will continue to second them and frame upcoming issues in legal reality. The discussion will touch on what SAFI´s interpretation genuinely means for the business and why it had caused problems to not only producers and distributors, but also consumers. Last but not least, the panel will offer a perspective of how to not let the inspection push producers of plant-based alternatives around and how to continue defending one´s own interests and interests of plant-based alternatives as such.
